Two legal practitioners, Reuben Boma and Okoro Nwadiegwu, along with the Incorporated Trustees of One Love Foundation, have filed a suit at the Federal High Court in Abuja to compel President Bola Tinubu to declare a state of emergency in Zamfara State. The suit is marked FHC/ABJ/CS/1363/25. The plaintiffs are also seeking the court to direct the National Assembly to undertake legislative functions for the state, arguing that the Zamfara State House of Assembly is not properly constituted due to the illegal suspension of 10 members, hindering its ability to form a legal quorum and conduct legislative business.
The plaintiffs argue that the prevailing security threats, communal clashes, and legislative crisis in Zamfara State constitute a breakdown of law and order, warranting the declaration of a state of emergency under Section 305 of the 1999 Constitution. They are asking the court to declare that, given the current security breakdown, legislative paralysis, and community unrest in Zamfara State, there is a state of lawlessness and imminent danger to the peace and stability of the state and the Federation. They also want the court to mandate the National Assembly to take over the Zamfara State House of Assembly.
The defendants in the suit include President Tinubu, the Attorney General of the Federation, the Speaker of the House of Representatives, the Attorney General of Zamfara State, and the Governor of Zamfara State. The court has not yet set a date for the hearing.
