IPOB Demands Nnamdi Kanu’s Acquittal, Claims No Case to Answer

The Indigenous People of Biafra (IPOB) has called upon the Federal High Court in Abuja to dismiss the ongoing case against its leader, Mazi Nnamdi Kanu, asserting that the prosecution has failed to establish a prima facie case. In a statement by IPOB’s Media and Publicity Secretary, Comrade Emma Powerful, the group emphasized that the government lacks sufficient evidence to proceed.

The statement referenced a legal reply filed on July 14, 2025, by Chief Kanu Agabi, SAN, which was a response to the Federal Government’s opposition to a no-case submission made by Kanu’s defense team. IPOB described this development as significant, highlighting that the defense arguments are grounded in constitutional and evidentiary principles.

Key arguments from the defense include:

  1. Unaddressed Legal Issues: IPOB pointed out that the prosecution did not adequately address several critical arguments raised by the defense, such as the absence of direct victims, lack of forensic authentication, and the nature of witness testimonies.
  2. Questionable Audio Evidence: The defense claims that the prosecution relies on edited audio recordings that have not been independently verified, raising concerns about their admissibility in court.
  3. Importation Allegation: One of the charges against Kanu involves the alleged importation of a transmitter, yet IPOB noted that no supporting documentation or evidence has been presented.
  4. Burden of Proof: The defense reiterated the constitutional principle that the burden of proof lies with the prosecution, maintaining that Kanu is presumed innocent until proven guilty.
  5. Technical Legal Concerns: IPOB also argued that certain charges may contain procedural or legal defects that could undermine their validity.

IPOB urged Justice Omotosho, who is presiding over the case, to consider these arguments carefully and deliver a ruling consistent with legal principles. They expressed confidence that this case could affirm the integrity of the judiciary and the principles of justice.

The group also encouraged civil society, media members, and international observers to closely monitor the proceedings. Mazi Nnamdi Kanu, who has been in custody since 2021, faces multiple charges, including allegations of incitement and unlawful broadcasting, to which he has pleaded not guilty.
