In a recent statement, the South-South Governors’ Forum, chaired by His Excellency Sen. Douye Diri, the Governor of Bayelsa State, has expressed significant concerns regarding the six-month declaration of a state of emergency in Rivers State, alongside the suspension of key democratic institutions. This declaration, made by President Bola Tinubu, has sparked debate about its constitutionality and the implications for governance in the region.

The forum acknowledged the President’s constitutional duty to maintain law and order throughout Nigeria. However, they emphasized that the political circumstances in Rivers State do not meet the criteria outlined in Section 305(3) of the Nigerian Constitution for such a declaration. This section specifies that a state of emergency can only be declared under certain conditions, including war, external aggression, imminent invasion, breakdown of public order, existential threats to Nigeria, natural disasters, or other significant public dangers.

The governors pointed out that the constitutional provisions for the removal of a governor and deputy governor, as detailed in Section 188, should be upheld. They noted that similar procedures exist for the removal of members of the House of Assembly and the dissolution of parliament. The forum raised concerns that these established guidelines may not have been fully considered in the decision to declare a state of emergency.

The South-South Governors’ Forum advocated for the resolution of political disputes in Rivers State through legal and constitutional channels rather than through executive fiat. They underscored the importance of dialogue and called for a calm and peaceful approach to the ongoing political issues in the state.

In a bid to reduce tensions and foster enduring peace, the forum proposed the immediate rescission of the state of emergency. They urged all parties involved to prioritize dialogue and reconciliation, emphasizing that now is a critical moment for constructive engagement.

The statement concluded with a call for unity and adherence to the constitution of the Federal Republic of Nigeria, reflecting the forum’s commitment to democratic principles and the rule of law in the South-South region.

As the situation unfolds, the South-South Governors’ Forum continues to monitor developments in Rivers State, advocating for a resolution that respects constitutional processes and promotes stability in the region.
